Misdiagnosis as a Form of Medical Malpractice

If a medical professional fails to make an accurate or timely diagnosis, a patient could experience some very serious complications. Most often, a patient will not receive any treatment or in other cases a patient might receive treatment for a condition that they do not even have. In many types of misdiagnosis cases, a patient has a strong basis on which to build a medical malpractice case. Not all diagnostic errors, however, are the basis for a lawsuit because there are some medical conditions that even reasonably skilled physicians or specialists are not able to diagnose. Instead, the misdiagnosis in question must have been the result of a medical professional’s negligent actions. In these situations, an experienced medical malpractice attorney like attorney Randolph Rice knows how to make sure that parties are held responsible for the various damages that can arise.

What Constitutes Medical Misdiagnosis

Misdiagnosis can arise in numerous situations. The most common way in which misdiagnosis tends to occur involves delayed diagnosis and mismanagement of diagnostic testing. Some of the most common examples of medical misdiagnosis include:

Establishing the Grounds for a Medical Malpractice Lawsuit

Not all errors involving misdiagnosis are medical malpractice. There are still some diseases and medical conditions that are too difficult to reliably diagnose all of the time. To establish a medical malpractice when misdiagnosis is involved, a person must show three things:

  • Doctor Patient Relationship. To establish a medical malpractice lawsuit, it must be shown that a patient had a relationship with their medical provider. This relationship just means that a person saw a medical professional, who agreed to diagnose and treat the person.
  • Negligence by the Medical Professional. Even highly skilled medical professionals can make diagnostic errors when practicing medicine. To show that negligence occurred, it must be demonstrated that a medical provider acted carelessly or outside the standards of care accepted by the medical community. In many cases, when making an assessment of a patient’s condition, medical professionals diagnose a person’s condition by considering all possible conditions and ruling out each possibility. When deciding if negligence occurred, a skilled medical malpractice attorney will determine how a reasonably skilled medical provider would have responded in the same situation. If other medical providers  would have made an accurate diagnosis, medical malpractice is likely.
  • Establishing Harm. After proving that a medical professional negligently diagnosed a patient, it is important to prove that a patient suffered harm as a result. A patient must establish that if they had received the appropriate diagnosis, they would not have been injured. Many times, the harm incurred by misdiagnosis is that a person ends up experiencing a much more advanced medical condition than they otherwise would have, which sometimes means that a person sometimes must undergo medical procedures that they would not have had to face.

Delayed Diagnosis

Delayed Diagnosis

In today’s modern climate of medicine, many recent breakthroughs have made it possible to care for patients at a rate and manner that was never believed possible. With all illnesses, early intervention is the best way to avoid facing complications. For example, if a person is able to catch cancer early enough then there is much less of chance that the illness will spread through a person’s body and advance into later stages and other organs. As a result, it can be particularly frustrating when a physician or other
medical provider fails to promptly diagnose a person’s signs and symptoms.

Delayed diagnosis can have particularly tragic consequences. Sometimes, failure to promptly diagnose a condition can result in the illness becoming too advanced to be treated effectively. If you are impacted by a delayed diagnosis that resulted in you having to combat a condition that was otherwise preventable, it is important to remember that you likely have a strong claim on which to base a medical malpractice case. A seasoned attorney like the legal counsel at the Law Office of Randolph Rice can help make sure that your case is as strong as possible so that you receive the compensation that you deserve for your injuries.

Common Causes of Delayed Diagnosis

Many people trust medical professionals to properly recognize systems, order adequate tests, and correctly diagnose a condition. Unfortunately, there are number of negligent ways in which medical professionals can end up failing to diagnose a condition. Some of the most common reasons why patients receive a delayed diagnosis include:

  • Failure to admit a patient for emergency treatment
  • Failure to diagnose known or likely complications
  • Failure to follow accepted post-surgical standards
  • Failure to note patient complaints
  • Failure to order the appropriate test
  • Failure to recognize the most serious diagnosis
  • Failure to refer a patient to the appropriate specialist
  • Failure to treat a heart attack in a timely fashion
  • Lost paperwork
  • Medical chart errors
  • Misreading diagnostic imaging, medical charts, or test results.

Consequences of Delayed Diagnosis

Sometimes, a delayed diagnosis does not result in much harm to a patient. In many cases, however, a patient’s health can become much worse as the result of a delayed diagnosis. In the cases of cancer, the condition can further spread through a person’s body resulting in a condition that is harder to treat with available methods like chemotherapy and radiation. Heart condition if not properly treated with early intervention can result in complications like bypass surgery, which is a particularly invasive surgery that requires a long period of time to recover. In other cases of delayed diagnosis, a patient might experience complications like blindness, nerve damage, paralysis, the loss of internal organs, or the need for amputations due to complications associated with later forms of a disease.

The Centers for Disease Control and Prevention (CDC) is reporting that as of October 10, 2012, 12 people have died in the U.S.. after receiving the steroid injections produced by drug manufacturer; New England Compounding Center (NECC).

What is a compounding center?

A compounding center is a company, like NECC, that repackages a drug in a smaller dosage or sells the drug in a different formula that treats a specific condition.  In this instance, the drugs sold to medical providers in the U.S. were an altered or reduced dosage drug that was infected with a fungus.
The compound that was sold by NECC is called methylprednisolone acetate and was sold to 75 clinics in 23 states.

What facilities in Maryland were shipped the fungus contaminate steroids?

As of October 10, 2012, the CDC is reporting that Maryland has had 9 cases of sick patients and 1 death.
If you were a patient of one of these facilities and you received an injection of steroid between May 21, 2012 and October 1, 2012, contact the meningitis steroid lawsuit attorneys at 410-288-2900 for a free consultation.

Where can I find the medical providers that were shipped the infected steroids from NECC?

The CDC has set up a site that provides the names of each facility that received the steroids, follow this link to the CDC Map site.
If you cannot make it to the office, we are able to overnight a packet of information as well as our claim forms that will allow our office to investigate your case and proceed with a lawsuit against the drug manufacturer. Call today for a steroid meningitis lawsuit packet, 410-288-2900.

Who regulates the compounding centers in the U.S..?

The compounding centers in the U.S.. are not overseen by the U.S.. Food and Drug Administration (FDA), instead they are regulated by each state where the compounding center is located.  There are about 3,000 compounding centers in the U.S.., that number has dramatically risen since 2000 when there were virtually none.

What should I do if I believe I received an injection of the infected steroids?

If you believe that you received an injection of the tainted steroids, you should contact your primary healthcare provider as soon as possible and schedule an appointment for a review.  It is now believed that the incubation period may be longer than originally thought.  The experts are saying that that is may take 6 to 42 days for signs of the infection to present itself.

How many vials of the steroid were shipped?

It is estimated by NECC that it shipped 17,676 vials of the tainted steroid.

Heart Treatments Overused, Study Says - WSJ.com

Heart Treatments Overused, Study Says - WSJ.com: "Outside of heart attacks, doctors are often too quick to use a common $20,000 procedure to treat patients suffering from coronary artery disease, a new study suggests.

About 600,000 angioplasty procedures, which almost always involve placement of a tiny metal tube called a stent, are done in the U.S. each year. Roughly 70% of these procedures are performed on patients suffering symptoms of a heart attack and aren't medically controversial. But the remainder are done on stable patients who are suffering mild symptoms or no symptoms at all. Of those, 50% are deemed appropriate, 38% uncertain and 12% inappropriate, the report says."  Click the link above to learn more or contact our office to schedule a free consultation.  No obligations, you may be entitled to monetary compensation.  No fee if no recovery.

New study scrutinizes heart stent procedures - latimes.com

New study scrutinizes heart stent procedures - latimes.com: "A new study of more than 500,000 cardiac patients who underwent recent cardiac stent or angioplasty procedures in the United States has found that up to 15 percent were either unnecessary or appeared to be of uncertain medical benefit.

However, nearly all of the procedures performed on cardiac patients experiencing acute symptoms such as a heart attacks appeared to have been medically appropriate, the study found.

About 75,000 cases were labeled as 'inappropriate' or 'uncertain' — almost entirely among the 144,700 patients with nonacute symptoms who underwent the procedures on an elective basis. The cases termed 'inappropriate' made up about 3.5 percent of those studied."

St. Joseph Stent Lawsuit Similar to Allegations in Tennessee Stent Claim

It appears that a Tennessee doctor is facing similar allegations of implanting unnecessary stents in patients as the current lawsuits filed in Maryland against Dr. Mark Midei and St. Joseph Medical Center. The Department of Justice (DOJ) is looking at Dr. Elie Korban of the Heart and Vascular Center of West Tennessee.

In later 2009, 369 patients of Dr. Mark Midei were notified by letter that they may have receive unneeded stent implants while at St. Joseph Medical Center.  This latest allegation in Tennessee follows a recent allegation in Pittsburgh, PA, where it is believed that doctors implanted unnecessary stents.

During the first part of 2010, another 169 patients of Dr. Mark Midei were notified of a possible unnecessary stent implantation.  All patients were notified they should seek review by their cardiologists of their current heart conditions.

Stents are often used by cardiologist to open blocked arteries with the use of a mesh tube.  The medical field typically recognizes a blockage of at least 70% as a medically necessary situation for use of a stent.  Yet we have found in our clients that some blockages were only 10% to 50%.

We are currently representing clients in St. Joseph coronary stent lawsuits that are filed individually and not a class action on behalf of all clients.  This ensures that each client has their individual rights protected and resolved per their claim.  Contact our Maryland Stent Lawyer G.
